Since April 2007, any deposit taken when a tenant rents a property on an Assured Shorthold Tenancy (AST) has to be lodged with a government approved deposit protection scheme. David Andrew usually requests a dilapidation deposit equivalent to six weeks rent from the tenant or more if the tenant has a pet.
There are 3 separate schemes available and David Andrew currently uses both MyDeposits and the TDS to register all deposits held by us in an insurance backed scheme.
The law requires any deposit taken to be registered by the Landlord or his agent within 30 days of receiving the funds from the tenant and for the necessary prescribed information to be served to the tenant along with a deposit protection. Failure to adhere to this could result in penalties equivalent to three times the value of the deposit and will void any vacate or eviction notices served.
We therefore recommend that you let us handle this procedure as part of our fully managed service and we can register the deposit for you, handle its return and make sure you stay on the right side of the legislation for a small administration charge of £60 inc VAT payable each time the protection renewed.
